Terms and Conditions
Eberspächer Zeliox B.V. warranty conditions for all ALL-In-One solutions (ECO+ NEO) with the Control Module ZCM6
1. Voluntary warranty extension – Guarantor – Scope
The guarantor is Eberspächer Zeliox B.V, Spaarpot 13, 5667 KV Geldrop, the Netherlands (hereinafter referred to as the "Guarantor"). The Guarantor grants the customer a free voluntary warranty extension ("Warranty") for all ALL-In-One solutions (ECO+ NEO) equipped with the Control Module ZCM6 (the "Product") in accordance with the following terms and conditions. The Warranty applies exclusively to Products purchased in a member state of the European Union or in another state of the European Economic Area (the "Territory" or “Scope”).
2. Warranty requirements
2.1 The Warranty is only granted if the customer
a) has purchased the Product from an authorized Eberspächer Partner or wholesaler located within the Territory,
b) has had the purchased Product installed by an authorized Eberspächer Partner,
c) registers the purchase of the Product within three (3) months from the purchase date in the corresponding Eberspächer web application or mobile app, and
d) completes the registration process in full and accurately.
2.2 The customer may complete the registration either via the web application through the Eberspächer portal (service.eberspaecher.com), the Eberspächer Zeliox website (www.eberspaecher-zeliox.com), or via the mobile app (EBE Product Registration). In the first step, the customer must create a OneID user account to identify themselves. In this context, the customer must accept the applicable terms of use provided in each case. If the customer is a consumer, they must also upload the serial number of the Product and the proof of purchase (invoice or similar document) as part of the product registration process. The proof of purchase must show the customer's name and address, as well as the date of purchase and the Product.
2.3 The customer may access a list of authorized Eberspächer Partners at any time on the following website: www.eberspaecher-climate.com/service-point
3. Duration and scope of the Warranty
3.1 The voluntary warranty extends the customer's existing statutory warranty rights by an additional warranty period (the "Warranty Period"), depending on the applicable national statutory warranty periods, to a total warranty period of five (5) years from the date of purchase.
Example:
Statutory warranty: 2 years → voluntary warranty: 3 additional years (Warranty Period of 3 years)
Statutory warranty: 3 years → voluntary warranty: 2 additional years (Warranty Period of 2 years)
3.2 The Warranty covers only defects that were already present at the time the Product was handed over to the customer.
4. Note: Statutory warranty rights remain unaffected
If the Product was not free of defects at the time of transfer of risk, the customer is entitled to the applicable statutory rights and claims, in particular warranty claims, against their seller. These statutory rights and claims are not limited by this Warranty; statutory rights and claims exist regardless of whether the warranty case occurs and whether the Warranty is claimed or not.
5. Warranty services – exclusions
5.1 The Guarantor shall decide at its own discretion on the type of subsequent performance in the event of a Warranty claim:
a) Repair of the product,
b) replacement with an equivalent product, or
c) replacement of individual components.
In addition, the Guarantor shall bear all necessary expenses incurred in connection with the subsequent performance.
Furthermore, no further claims against the Guarantor shall arise from the Warranty, in particular no claims for damages or claims for reimbursement of expenses/costs incurred by the customer in connection with the subsequent performance.
5.2 Replaced parts or products become the property of the Guarantor.
5.3 The Guarantor is entitled to use an authorized Eberspächer partner to fulfill its obligations arising from the Warranty .
5.4 The Warranty and any claims arising therefrom are excluded if
a) a defect is attributable to improper installation or improper operation, use, maintenance, or repair, either by the customer or by third parties;
b) the Product has been tampered with, modified, or fitted with unauthorized replacement parts;
c) damage has been caused by the Product being used for purposes other than those intended;
d) damage has been caused by failure to comply with the operating instructions;
e) damage was caused by external influences (e.g., accident, malicious acts, force majeure, animal bites, chemical, electrical, or other unintended effects);
f) the Product was not purchased from an authorized Eberspächer Partner;
g) damage has been caused by natural wear and tear and/or deterioration.
5.5 The Warranty is tied to the Product. The Warranty can therefore be transferred to third parties, provided that the conversion, reinstallation, or resale is carried out by an authorized Eberspächer Partner of the Guarantor. However, the scope of the Warranty and the Warranty Period are determined solely by the initial registration of the Product. An existing Warranty is transferred by re-registering the Product to the third party by such third party. Without the corresponding re-registration, the third party has no claim against the Guarantor.
6. Handling of warranty claims – Miscellaneous
6.1 If a warranty claim arises within the warranty period, the customer must first contact the seller or authorized Eberspächer Partner from whom the product was purchased. The seller or authorized Eberspächer Partner will coordinate further processing. The warranty service will be performed by an authorized Eberspächer Partner designated by the Guarantor within the Scope.
6.2 The customer must report a warranty claim immediately after becoming aware of it. The customer must present the proof of purchase upon request.
6.3 A Warranty in accordance with these terms and conditions shall be provided for parts installed or repaired under the Warranty or for a replacement delivery until the expiry of the originally agreed Warranty Period. Warranty services do not result in an extension or restart of the Warranty Period.
6.4 These warranty terms and conditions and the resulting legal relationship between the customer and the Guarantor are governed by Dutch law, excluding the provisions of conflict of laws and the UN Convention on Contracts for the International Sale of Goods (CISG).
